Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PerfectLaunch.ai (the “Service”), operated by BookGenius, Inc. (“PerfectLaunch”, “we”, “us”). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you agree on its behalf and represent that you have authority to do so.

1. The Service

PerfectLaunch provides AI-assisted interview scoring and hiring-workflow software, including optional integrations you choose to connect (such as email). We may update, improve, or change the Service over time.

2. Accounts

You are responsible for your account, for keeping your credentials secure, and for all activity under your account. You must provide accurate information and promptly update it as needed. You must be at least 18 years old to use the Service.

3. Acceptable use

You agree not to:

• use the Service to violate any law or the rights of others;
• upload unlawful, infringing, or harmful content, or data you lack the right to process (including candidate data you are not authorized to handle);
• attempt to gain unauthorized access to, disrupt, or reverse-engineer the Service; or
• use the Service to send spam or unsolicited communications.

4. Your data

As between you and us, you retain all rights to the data you submit to the Service (“Customer Data”). You grant us a limited license to host, process, and use Customer Data solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy, including data accessed through connected Google accounts, which is used only as described there and in compliance with the Google API Services User Data Policy (including its Limited Use requirements).

5. Third-party services

The Service integrates with third-party services (for example, Google Gmail) at your direction. Your use of those services is governed by their own terms, and we are not responsible for them. You are responsible for maintaining any third-party accounts you connect.

6. Fees

Paid plans are billed in advance on a recurring basis and are non-refundable except as required by law. Metered usage (such as scored interviews) may incur additional charges as described at purchase. We may change pricing on prospective notice.

7. Intellectual property

The Service, including its software, content, and trademarks, is owned by PerfectLaunch and its licensors and is protected by law. These Terms grant you no rights to it except the limited right to use the Service.

8. Confidentiality & feedback

Each party will protect the other’s non-public information. If you send us feedback or suggestions, we may use them without restriction or obligation to you.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated outputs (including interview scores and suggestions) are aids for human judgment, may be inaccurate, and are not hiring decisions or advice. You are responsible for your hiring decisions and for compliance with employment laws.

10. Limitation of liability

To the maximum extent permitted by law, PerfectLaunch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to these Terms or the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

11. Indemnification

You will indemnify and hold PerfectLaunch harmless from claims arising out of your Customer Data, your use of the Service, or your breach of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Service or comply with law. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.

13. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in Florida.

14. Changes

We may update these Terms; material changes will be reflected by the “Last updated” date above. Continued use after changes take effect constitutes acceptance.
